Ooh, ooh, pick me!

Quoting from CNN:
President Bush today nominated White House counsel Harriet Miers to replace retiring Supreme Court Justice Sandra Day O'Connor. "She will strictly interpret our Constitution and laws. She will not legislate from the bench," Bush said. Miers, who has never been a judge, has been leading the White House effort to help Bush choose nominees to the Supreme Court.

I can imagine the conversation went something like this.

Bush: Ms. Miers, I'd like you to find someone I can appoint as the next Supreme Court Justice.

Miers: Pick me!

Bush: Are you qualified?

Miers: No, but neither was Mike Brown

Bush: True. Alright, you're in.

Soneone sitting as a judge previously - as I was pointed out by mooivos this morning; isn't a requirement - as was shown by Warren Burger. (Although he did sit as an appeals judge apparently.)

My larger concern was that as White House Council, should there be an issue of impeachment, or a matter dealiong with the White House (even down the line after Bush is out of office) there is a perception of "separation of powers" and "conflicted interest" that concern me. As mooivos stated, they could recuse themself in such a role - but it could result in a deadlock 3 to 3 decision on an issue of vital importance in a time of crisis or social unrest.

Now that... concerns me.

Regarding the perception of "separation of powers" and "conflict of interest" I might point out that Taft was both President of the United States, and a Supreme Court Justice.

Another aspect of concern is that Miers has been leading the White House effort to help Bush choose nominees to the Supreme Court. She was the one tasked with finding nominees, and somehow she managed to slip her own name at the TOP OF THE LIST?

(And a deadlock at the Supreme Court level would be 4-4, not 3-3)

Excellent! The #1 Winnar of this country is picking more Winnar's to foul up even more the original foundation of this country's government. Ahh well, no one wants to listen to reason around this place, so it's probably a lost cause to keep bitching... even though I do. :P
